Thai to English Law/Patents Law (general) Court proceedings.
Two defendants failed to appear in court. The judge issued warrants for their appearance on a subsequent date. The last sentence of the record reads ให้โจทก์นำส่งภายใน ๗ วัน ไม่มีผู้รับโดยชอบให้ปิด What do you make of the last part, ไม่มีผู้รับโดยชอบให้ปิด ? Is the case to be closed if the warrants cannot be served? Or...?

"the plaintiff shall deliver the subpoena [to the defendant etc.] within 7 days; patch it on the [visible area of the] facility if there is no valid recipient" is a Thai legal jargon.

If I understand you correctly, this means that the subpoena is to be posted in a public place if it cannot be served on the defendant or witness. Is this what you mean? Thanks.

If no valid addressee or acceptance of service, the summons shall be patched on the facility


No, it does not mean that “the case is to be closed if the warrants cannot be served”

1) A plaintiff shall file a complaint in writing and pay Court fees for such action (so that, upon acceptance of the complaint by the court, a summons to answer shall be issued)

2) ให้โจทก์นำส่งภายใน ๗ วัน = The plaintiff must pay the Court fee for summons issuance and request the Court office to serve the summons on the person named as defendant within 7 days from the entry of the complaint.

3) ไม่มีผู้รับโดยชอบให้ปิด = If 1) the defendant (addressee) cannot be located at his/her given address, 2) the defendant can be located at that address but refuses to receive the summons or 3) the defendant cannot be located at that address, but any person (or relatives) with the legal age of 20 at that address refuses to receive the summons (no acceptance of service), the Court officer shall patch the summons on a visible area of that facility.

Remark:

A summons can be delivered by mail, a Court officer without patching on the facility and by a Court officer with patching on the facility. This particular summons falls into the third category:

Thank you for your complete and clear answer. "Patch" doesn't work in English, however - "Post" is the appropriate word. I awarded the points to Dr. Soonthorn since he was first and he did point me in the right direction to find the answer on Google.
