Discussion

jankaisler Apr 5, 2012:
I just respect the English definition - see my link ... the main point is "equality and mutual independence".
Gerry Vickers Apr 5, 2012:
Weird - I was just this moment translating this sentence: '... že jednají vážně a určitě, že se tak nestalo v tísni ani za jinak nápadně nevýhodných podmínek' when I noticed this post :)
Charles Stanford Apr 5, 2012:
Because you might as well use something that people actually use in practice Jan.... The arm's length principle is a very common term in English so you cannot just invent something in Czech that means roughly the same
jankaisler Apr 5, 2012:
Institut "arm's length principle (ALP)" je formulován pozitivně, tak proč jej překládat negativně?

dle/na principu rovného (a nezávislého) postavení

"The arm's length principle (ALP) depicts the condition or the fact that the parties involved in a transaction are on equal footing and independent; these transactions are called "arm's-length transactions". This principle is used especially in the field of contract law in order to arrange an agreement that is legally acceptable, even if the parties are seen to be too closely related to be completely independent (e.g., when there are familial ties between the parties) or when the parties have shared interests (e.g., employer-employee)."

nikoli za jednostranně nevýhodných podmínek

This is the formulation I seem to come up against in quite a lot of Czech contracts
