1. Bij akte van appèl van 6 november 2006 zijn appellanten (gezamenlijk aan te duiden als: "Schena") in hoger beroep gekomen van het vonnis van het Gerecht in Eerste Aanleg d.d. 26 september 2006. GeTntimeerden warden, tenzij anders aangegeven, gezamenlijk aangeduid als "AKGr.
2. Schena handhaven al hun stellingen uit de eerste aanleg inclusief de stellingen die zij uitdrukkelijk tot de hunne gemaakt hebben door verwijzing in het inleidend verzoekschrift (zie sub 9 verzoekschrift), waarbij de door Schena gediende stukken uit de door verval van instantie (althans voorlopig) gestrande zaak gevoerd onder AR 478/1995 zijn overgelegd, een en ander slechts behoudens indien en voor zover in de onderhavige memorie uitdrukkelijk anders mocht worden aangegeven.
3. Schena verwijzen derhalve uitdrukkelijk naar alle namens haar gediende processtukken In eerste aanleg (inclusief de processtukken uit de procedure AR 478/1995 waarnaar werd verwezen). Schena verzoeken Uw Hof beleefd het in die processtukken gestelde hier als herhaald en ingelast te willen beschouwen.

1. In the notice of appeal dated November 6, 2006, appellants (hereafter to be referred to collectively as "Schena") appealed the sentence of the Court in the First Instance dated September 26, 2006. Appellants will be referred to collectively as "AKGr, except otherwise indicated.
2. Schena uphold all their propositions as in the first instance including the propositions they emphatically made their own by referring to the initiatory application (vide initiatory application sub 9), whereby the evidence handed in by Schena from the (at least, provisionally) dismissed case by virtue of lapse of dismissal of the action for want of prosecution, case number AR 478/1995 , only except otherwise indicated in the case under consideration.
3. Consequently, Schena emphatically refer to all the evidence handed in on her behalf in the first instance (including the evidence from the proceedings AR 478/1995 which were referred to). Schena kindly requests the Court to consider that which is stated in the evidence to be repeated and inserted here.
