Under Decree 186/2004/ND-CP, the width of the safety corridor was specified as 20m from the edge of the foot of the embankment, the top of the cutting, or the outer edge of ditches. This also applied to Class I and II highways. This was revised under Decree 11/2010/ND-CP, which increased the safety corridor for expressways to 47m, while reducing it to 17m for Classes I and II. For urban expressways the corridor is 40m.
6. The land in safety corridors will not be acquired, but the law restricts landowner’s permitted development, especially in residential lands where building of new houses or even improvement of existing structures are prohibited.
7. For productive land, there is no significant restriction, as affected households with agricultural land within the safety zone can continue to cultivate it, except for tall trees which would restrict sight distance at curves. Householders with residential land within the safety zone are restricted from building a new house or improving existing property.
8. Government has not yet issued any clear guidelines on compensation or assistance to be given to affected households within the expressway safety corridors. Donors have tended to take a conservative approach and have demanded high compensation rates for affected persons and this has delayed or affected the feasibility of projects.
9. Decision 39/2011/TT-BGTVT has been issued guiding implementation of Decree 11/2010/ND-CP, but it does not provide improved clarity on compensation procedures.

Theo Nghị định 186/2004/ND-CP, bề rộng hành lang an toàn đường bộ trật tự giao thông được xác định là 20m tính từ mép chân mái đường đắp, mép đỉnh mái đường đào, mép ngoài rãnh dọc hoặc mép ngoài của rãnh đỉnh đường trở ra. Quy định này cũng được áp dụng cho đường ô tô cấp I và cấp II. Điều này đã được điều chỉnh trong Nghị định 11/2010/ND-CP trong đó hành lang an toàn đối với đường cao tốc được tăng lên thành 47m, đối với đường cấp I và cấp II là 17 m, đối với đường đô thị là 40m.
6. Đất thuộc phạm vi hành lang an toàn đường bộ sẽ không bị thu hồi nhưng pháp luật hạn chế cấp phép xây dựng cho người sở hữu, đặc biệt là cấm xây dựng nhà mới hoặc nâng cấp kiến trúc hạ tầng hiện có đối với đất thổ cư.

Đất sản xuất, việc hạn chế là không đáng kể vì các hộ gia đình bị ảnh hưởng trong phạm vi hành lang an toàn giao thông có thể tiếp tục canh tác trừ trường hợp trồng các cây cao làm giới hạn tầm nhìn tại các đường cong. Các chủ hộ có đất thổ cư nằm trong phạm vi hành lang an toàn giao thông thì bị cấm xây dựng nhà mới hoặc cải tạo bất động sản hiện có.
8. Chính phủ hiện vẫn chưa ban hành chỉ dẫn rõ ràng về bồi thường hoặc hỗ trợ cho các hộ dân bị ảnh hưởng trong phạm vi hành lang an toàn của đường cao tốc. Các nhà tài trợ đã có xu hướng áp dụng phương hướng cổ điển và đã yêu cầu mức bồi thường cao đối với người bị ảnh hưởng gây ra sự trì hoãn hoặc ảnh hưởng tới tỉnh khả thi của Dự án.
9. Thông tư 39/2011/TT-BGTVT đã được ban hành để hướng dẫn thực hiện Nghị định 11/2010/ND-CP nhưng nó chưa cung cấp thông tin rõ ràng hơn quy trình thủ tục bồi thường.

I have been working as translator for several ODA Projects implemented in Vietnam where I have chances to work with many international consultants and involve in translation of many project documents including academic reports since 2009. In addition, after projects, those consultants who I used to work with often contact me to ask for part-time translation service for their other projects as well. I believe with my experience in translation I would meet the client requirement if I was assigned for the task.
